Family Based Immigration Attorneys

The Immigration and Naturalization Act provides for unlimited immediate family immigration. Immediate family is defined as having as being a spouse or child of a US citizen, or being adopted by a US citizen, or being the parent of a US citizen who is over the age of 21. Getting a visa for an immediate relative requires filing a Form I-130, the petition for an alien relative.

More distant relatives may also be granted visas based on their family based immigration status. However, the number of these visas is limited each year, and must be allotted among four categories of preference. The vast majority of visas issued each year goes to the spouses and minor children of lawful permanent residents, followed by their unmarried older children. Should the number of petitions exceed the number of available visas for the year, the date of application determines which requests will be honored.

Not every family member can sponsor a relative for immigration. US family immigration law does not allow grandparents, aunts, uncles, cousins and in-laws to sponsor a relative. This is merely one example of the complexity of family based immigration law.
